§ 4-255. Contents of assurance documents.

  • The type of assurance of completion document chosen by the developer in accordance with this Land Development Code shall recite, in substance, that:

    (1)

    Improvements approved by the city shall be completed in accordance with approved specifications and plans and in accordance with the standards set out in this Land Development Code for such improvements.

    (2)

    In the event such improvements are not completed within the time specified, the city shall be entitled to draw or make claim against said document and the principals thereto for monetary amounts sufficient to complete the improvements which remain incomplete or which have not been installed as required.

    (3)

    The document inures to the benefit of the city.

    (4)

    The developer is responsible for requesting a final inspection of the improvements at least 60 days prior to the termination of the document.
